  • Financial and loan-related information: loan amount, property address, security value, borrower entity type, and deal description submitted through our enquiry forms

  • Records of correspondence between you and Vía Private
  • Website usage information: IP address, browser type, pages visited, and referring URLs collected via analytics tools

We collect personal information:

  • directly from you when you submit a deal enquiry, contact form, or partner enquiry through our website
  • from mortgage brokers who submit deal enquiries on behalf of their clients
  • from credit reporting bodies
  • through cookies and analytics tools when you browse our website
  • through direct email and telephone communications

If you provide us with personal information about another individual (for example, a borrower you represent as their broker), you should ensure that individual is aware of and consents to the collection and use of their personal information as described in this Policy.

5. Why we collect your information

We collect, hold, use, and disclose personal information to:

  • assess loan enquiries and applications submitted through our website
  • communicate with brokers and borrowers about loan proposals and transactions
  • assess your creditworthiness and verify your identity
  • document, settle, administer, and enforce loans, including recovering amounts owing
  • comply with our legal and regulatory obligations, including those under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
  • respond to complaints and general enquiries
  • improve our website and services

We will not use your personal information for purposes other than those described without your consent, or as required by law.

  • other credit providers and financial institutions
  • prospective funders or other intermediaries (such as finance or mortgage brokers, mortgage originators, and mortgage managers) and persons who assist us to provide our products to you
  • any person who represents you, such as finance brokers, lawyers, mortgage brokers, guardians, persons holding power of attorney, and accountants
  • other guarantors or borrowers (if more than one), and borrowers or prospective borrowers in relation to any credit you guarantee or propose to guarantee
  • legal, valuation, and settlement service providers engaged in connection with a loan transaction
  • credit reporting bodies, where required or permitted by applicable law (see section 7 below)
  • any industry body, tribunal, court, or otherwise in connection with any complaint regarding the approval or management of your loan
  • other organisations involved in managing or administering your finance, such as third-party suppliers, printing and postal services, call centres, lenders, mortgage insurers, trade insurers, and credit reporting bodies
  • companies that provide information and infrastructure systems to us
  • our agents, contractors, or external service providers to outsource certain functions (for example, statement production, debt recovery, and information technology support)
  • our auditors, insurers, re-insurers, and health care providers
  • claims-related providers, such as assessors and investigators who help us with claims
  • investors, agents or advisers, trustees, rating agencies, or any entity that has an interest in your finance or our business

7. Exchange of information with Credit Reporting Bodies

As a commercial credit provider, we may obtain credit information about borrower entities and proposed individual guarantors from credit reporting bodies (CRBs) and commercial credit bureaus. We use that information to confirm identity, assess creditworthiness, and assess applications for credit.

Where an individual is proposed as a guarantor of credit we provide to a company or other business entity, we may obtain a consumer credit report about that individual from a CRB in reliance on section 21G of the Privacy Act 1988 (Cth). We will use and disclose that consumer credit information only for the purpose of deciding whether to accept the individual as a guarantor.

A CRB may record our enquiry on the individual's credit file, disclose it to other credit providers, and use this information to assess creditworthiness and calculate a credit score or credit rating. A credit enquiry may impact a credit score or credit rating, as CRBs may take into account the number and frequency of such requests when calculating a credit score.

The information we may obtain from a CRB about a proposed guarantor includes identification details, the types and amounts of credit reported, payment information, default information, court proceedings information, personal insolvency information, and publicly available information. We do not provide consumer credit and we do not report repayment history, default, or financial hardship information about any individual to a CRB.

You can ask a CRB not to use your credit information for the purposes of pre-screening or direct marketing. You can also ask a CRB not to use or disclose your credit information if you have reasonable grounds to believe that you have been, or are likely to be, a victim of fraud. You have the right to request access to credit information that we hold about you and to request correction of that information if needed.

8. Overseas disclosure

We may disclose your personal information (including any credit information we hold about you) to overseas entities that provide support functions to us. Recipients may be located in New Zealand, the Philippines, the United Kingdom, Ireland, and the United States.

Before we disclose any of your personal information to another entity, we take all reasonable steps to satisfy ourselves that the entity has a commitment to protecting your personal information at least equal to our commitment, or that you have consented to us making the disclosure.

The personal information we hold about you may be held by us in electronic form on our secure servers and may also be held in paper form. We may use cloud storage to store personal information, including credit information. The cloud storage and IT servers may be located outside Australia. We will not disclose any consumer credit information obtained about an individual under section 21G of the Privacy Act 1988 (Cth) to a recipient that does not have business operations in Australia.

9. Identity verification

We may verify your identity using information held by a CRB. To do this, we may disclose your personal information such as your name, date of birth, and address to the CRB to obtain an assessment of whether that personal information matches information held by the CRB. The CRB may give us a report on that assessment and to do so may use personal information about you and other individuals in their files. Alternative means of verifying your identity are available on request.

We may also verify your identity by collecting, using, and disclosing the information derived from your government-issued documents (such as your Australian passport, state or territory driver licence, Medicare card, citizenship certificate, or birth certificate) to the relevant government agency via the Document Verification Service (DVS), provided we have obtained your express consent to do so.

10. Direct marketing

We may use your personal information for the direct marketing of products and services offered by Vía Private or an organisation we are affiliated with or represent. If you do not wish to receive direct marketing information, please contact us at any time to opt out. We will not charge you for giving effect to your request.

We do not sell, rent, or trade personal information to third parties for their marketing purposes.

We take reasonable steps to protect personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. This includes technical and administrative security measures.

No method of transmission over the internet is completely secure. While we take reasonable precautions, we cannot guarantee the absolute security of your information.

You have the right to request access to personal information (including any credit information) we hold about you, and to request correction of information that is inaccurate or out of date. To do so, please contact us using the details in section 16 below.

We will respond to access and correction requests within a reasonable time, generally within 30 days. In limited circumstances we may decline to provide access, in which case we will explain why in writing.
